The Chess Store Agreement

This agreement has been set up to protect the rights and obligations of our customers (‘you’,’your’) as well as www.thechessstore.co.uk (‘TCS’). This agreement is a legal document which sets out your rights and obligations, and those of TCS, in relation to any services offered by us through this site. Any products ordered from TCS will be referred to as goods or products or services in this agreement.

Each transaction shall be goverened by English Law and the Courts of England and Wales, including (without limitation) all contractual and other relationships, which arise as a result of such sales.

By purchasing goods from the TCS website you are entering a legally binding contract and are governed by the terms of this agreement.

No contract exists between you and us until TCS has confirmed receipt and acceptance of your order. TCS is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods or the order appearing on the site. We also reserve the right to issue any refunds or cancel an order should the product ordered be out of stock without any issue or dispute from you.

We ask that you agree to register for TCS using your correct name, address and any other requested details. All payments are processed by one of two external payment processors; Paypal or Stripe. We do not store credit card details nor do we share customer details with any 3rd parties.

You must ensure that you comply with the following:
a) you are entitled to use the payment method at the time when you provide those details to TCS
b) the account has available funds to cover all charges incurred at the time it is used

Descriptions of goods and services included in the TCS site are accurate to the best of our knowledge. Errors are corrected as soon as we are aware of them. If after you have received the goods the description varies excessively from the product you have received you may return them for a full product refund.

You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever.

All orders will need to be signed for at point of delivery, so please make sure someone is available to sign. Please check orders for any obvious signs of damage at time of delivery and to sign for the item as damaged where necessary. Any damage must be reported to us as soon as possible, but no later than 7 working days after you have signed for the product(s). Photographs of the damaged goods must be included with the notification wherever reasonably possible.
Any import duties on goods that may be due on any orders delivered outside of the United Kingdom are the responsibilities of the buyer and are to be conducted between you and the relevant port authority or revenue agency.

If the courier has attempted to deliver your goods and you fail to arrange a redelivery or if you do not respond to the “sorry we missed you” card left by your driver, your order will eventually be returned to the sender.

This incurs The Chess Store a fee of £12 which we cover, however the buyer is liable to pay postage costs for redelivery. In the UK that will be £5.95 for the rest of the world it will depend on location.

All products are covered by a six months warranty against manufacturing defects. If your product develops a fault that is covered by the manufacturers guarantee, we will replace the relevant part.

TCS will not be liable to you or any third party for any indirect loss or damage, or for any loss of data, profit, revenue, business, or management. We advise that you keep the original packaging and flatpack it for storage in the event of the product being returned as we do not supply repackaging material and courier services may refuse collection if not properly packaged.

TCS shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. All goods are delivered by third party couriers.
Price and availability information are subject to change without notice. TCS reserves the right to change the terms of this agreement from time to time, and to post a new version on our website. The new version will take effect from the date of its posting on the website.

If any term in this agreement is held unenforceable, the remainder of this agreement shall still remain valid.

Personal Data:
Our Data Retention period is a maximum of 10 years in line with accounting best practises. We will from time to time actively cleanse our client data for privacy protection.
You have the right to withdraw consent for the use of your personal data, except where it is a requirement for us to keep details of a completed order for tax, accounting, or AML purposes.

Complaints Procedure:
The Chess Store (or TCS) takes great pride in our customer service and customer relations.
If in the unlikely event that you feel you need to make a complaint you can do so by emailing sales@thechessstore.co.uk for the fastest response.

We will acknowledge receipt of your complaint within 5 working days from the date of receiving your complaint. We will do our upmost to rectify or resolve your complaint within the 5 working days but in a case where we are unable to resolve the complaint within the 5 working days we will contact you to let you know we have received your complaint and we will advise what is causing the delay and will advise when our outcome will be available.

We also support the EU Online Dispute Resolution process.

Unless specifically asked not to we will reply to any complaint by emailing a response to the email address registered to your account on this website.

TCS reserves the right to suspend or terminate any members account which, is, or appears to us in our absolute discretion, to be, in breach of any of the provisions of this agreement.
